Breath tests have an “acceptable” margin of error of .02% 
While this number may sound small, it can actually be a significant factor in your case.  This .02% can mean the difference between being above the legal limit (.08%) and below it.  Consider this:  if your BAC is .06%, and the machine is off by .02%, you could be arrested, even though your BAC was actually within acceptable levels.

Breath tests are only accurate if you haven’t had a drink within one hour
This little-known fact is one of the most important.  If you are just coming home from the bar, chances are you had a drink less than two hours ago.  This can cause the breath test to register a higher-than-accurate result.

Officers must watch you continuously for 15 minutes before administering the test
